Terms of Service for CloakWrite

1. Acceptance of Terms

By creating an account, accessing, or using CloakWrite at https://cloakwrite.com, you agree to these Terms of Service ("Terms"). If you do not agree, do not use CloakWrite.

2. Description of Service

CloakWrite provides AI-powered text humanization and AI detection tools. Our service:

• Rewrites AI-generated text to reduce AI detection probability
• Detects the likelihood that text was generated by AI
• Provides additional content generation tools on higher-tier plans (Blog Writer, Agent)
• Is accessible via web application

3. Eligibility

You must be at least 13 years old to use CloakWrite. By using the service, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.

4. Accounts

Registration: You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials.

Accuracy: You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

One account per person: Creating multiple accounts to circumvent plan limits is prohibited and may result in all associated accounts being suspended.

Account security: You are responsible for all activity that occurs under your account. Notify us immediately at support@cloakwrite.com if you suspect unauthorized access.

5. Acceptable Use

You agree to use CloakWrite only for lawful purposes. You may not use CloakWrite to:

• Submit text that contains illegal content, including content that violates copyright, defames individuals, or facilitates illegal activity
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or source code
• Use automated scripts, bots, or tools to access the service in ways that exceed your plan limits or circumvent rate limiting
• Resell, sublicense, or redistribute access to CloakWrite without written permission
• Submit content that is obscene, threatening, or violates the rights of others
• Impersonate another person or entity
• Attempt to gain unauthorized access to our systems or other users' accounts

Academic integrity:CloakWrite is intended for legitimate writing assistance. Users are solely responsible for ensuring their use of CloakWrite complies with applicable academic integrity policies, institutional rules, and any other obligations they may be subject to. CloakWrite does not warrant that use of the service will satisfy any particular institution's academic integrity requirements.

6. Plans, Billing, and Word Balances

Plans: CloakWrite offers Free Trial, Starter, Pro, and Ultra plans. Features and word limits vary by plan as described on our pricing page at https://cloakwrite.com/pricing.

Free Trial: The free trial provides a one-time balance of 500 words that does not reset monthly. Once exhausted, you must upgrade to a paid plan to continue using the service.

Word balance: Words are consumed when you use the humanizer or detector. Word balances reset on your monthly billing date for paid plans.

Billing: Paid plans are billed monthly or annually in advance. All prices are in US dollars. Payments are processed securely by our payment provider. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

Refunds: We offer refunds within 7 days of any paid subscription charge if you have not used more than 10% of your monthly word balance. Contact support@cloakwrite.com to request a refund. We do not offer refunds after 7 days or for partial months.

Price changes:We may change our pricing with 30 days' notice provided by email to your registered address.

7. Intellectual Property

Your content: You retain ownership of all text you submit to CloakWrite. By submitting text, you grant us a limited, non-exclusive license to process that text solely for the purpose of providing the service to you.

Our service: CloakWrite, including its software, design, trademarks, and underlying technology, is owned by CloakWrite and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the service without written permission.

Output:Text produced by CloakWrite's humanization engine is based on your input. You are responsible for reviewing output before use and for compliance with any applicable laws or policies.

8. Third-Party Services

CloakWrite uses third-party APIs and infrastructure providers to deliver its service. We are not responsible for the availability, accuracy, or output quality of these third-party services. Service availability depends in part on these providers.

9. Disclaimer of Warranties

CloakWrite is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The service will be uninterrupted, error-free, or available at any particular time
• The humanized text will pass any specific AI detector
• The detection scores are accurate or will match results from other detection tools
• The service will meet your specific requirements

10. Limitation of Liability

To the maximum extent permitted by law, CloakWrite and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to:

• Loss of data or content
• Academic or professional consequences from use of our output
• Business losses or lost profits
• Costs of substitute services

Our total liability to you for any claims arising from these Terms or your use of CloakWrite shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CloakWrite, its operators, and any third-party service providers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third party's rights.

12. Termination

By you: You may close your account at any time by contacting support@cloakwrite.com or using the account deletion option in settings.

By us: We reserve the right to suspend or terminate your account without notice if you violate these Terms, engage in fraudulent activity, or if we determine your use is harmful to other users or the service.

Upon termination, your right to use the service immediately ceases. We may delete your account data in accordance with our Privacy Policy.

13. Changes to Terms

We may update these Terms at any time. For material changes, we will provide at least 14 days' notice by email or in-app notification. Your continued use of CloakWrite after the effective date of updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using the service and may close your account.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which CloakWrite operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

15. Dispute Resolution

Before initiating any formal legal proceedings, you agree to contact us at support@cloakwrite.com to attempt to resolve any dispute informally. We will try to respond to your complaint within 30 days.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CloakWrite regarding your use of the service and supersede any prior agreements.
